NBC News · Judge rules some key evidence in Luigi Mangione's state trial must be suppressed
- 1. A judge ruled that the initial search of a defendant's backpack at a McDonald's location was improper and warrantless.
- 2. The court found the backpack was not within the defendant's immediate control or "grabbable area" at the time of the McDonald's search.
- 3. The prosecution, referred to as "the people," failed to provide evidence of "exiting circumstances" that might justify a warrantless search.
- 4. As a direct consequence of these legal improprieties, all items discovered inside the backpack during the search conducted at McDonald's will be suppressed from evidence in the trial.
- 5. In contrast to the McDonald's incident, the court determined that a subsequent search of the same backpack conducted later at the police station was valid.
- 6. The validity of the station search was specifically attributed to it being a "valid inventory search."
- 7. Consequently, any evidence or items recovered from the backpack during this lawful inventory search at the police station will not be suppressed and can be used in the trial.
